EMERGENCY CUSTODY ORDERS

This is why states allow emergency custody orders to be petitioned, in which you may obtain custody of your child without any notice to the other party. In this process, you must be able to prove, with concrete evidence, that you believe your child is in serious danger when he was she is in the care of your ex. Examples of immediate and clear harm include drug and alcohol use, physical, emotional, or sexual abuse, and more. If the judge grants use emergency custody, you will later have to attend a hearing, in which the opposing side will present his or her case.
